LO 19 – Executive Privilege and Its Limitations – U.S. v. Nixon

Executive Privilege: A President has certain privileges simply because of the powers of the office.

Known as the “Watergate Tapes” case.

President Nixon attempted to assert privilege to deny the public and the court access to taped conversations made in his office.

The Supreme Court ruled that privilege did not protect the President from complying with a court order—turning over possible criminal evidence.

LO 21 – Executive Orders and Executive Agreements

Executive Order: A President has the ability to issue domestic orders on administrative matters. These have the effect of law when they are issued.

Example?

Executive Agreement (also known as a National Security Directive): A President has the ability to issue foreign orders on administrative matters.

These have the effect of law when they are issued.

A treaty must be approved by 2/3 of the Senate before becoming law.

LO 22 – Define a Signing Statement

Signing Statement:

Written presidential declarations commenting on the bill that is being signed into law—often including criticism of one or more provisions.

LO 23 – War Powers Resolution

War Powers Resolution:

A President may commit troops for 60 days without Congressional approval. After 60 days, if Congress does not agree, the troops must be brought home in the next 30 days, for a total of 90 days.

Problems:

When does the 60 days begin? Time factor is too short for success.

Once commitment is made, pulling out troops is unlikely given resources spent to deploy.

Congress doesn’t want to vote to end situation; works like a vote whether or not to go to war, which is unpopular.
